The Patiala House Court today ordered the removal of specific recordings from Youtube, which contain hate speeches about the Sikh Gurus and Sikh religion.
The order was passed in a civil suit documented by one GS Walia against Google (proprietor of Youtube). The plaintiff recorded an application for grant of ex-parte ad-interim injunction for the purpose of directing Youtube to remove all videos of one Sakshi Bhardwaj containing such hate speeches and hostile comments against the Sikh Gurus and the Sikh Religion.
An application for hearing the issue in the chamber and under camera was additionally moved by the plaintiff. Considering the delicate nature of the issue, the application was permitted.
Representing Plaintiff, Advocate Gurmeet Singh presented that the application is heard ex-parte as the hate speeches are as of now available for use and are probably going to spread public disharmony. It was likewise presented that Google has declined to expel the recordings from Youtube without the intervention of the court.
While conceding the ex-parte interim injunction for the offended party, Civil Judge Jasjeet Kaur observed that,
“The devotees of the Sikh religion and faith are probably going to feel a grave insult to their religious sentiments by circulation of such offensive recordings of Sakshi Bhardwaj via web-based networking media. In addition, social congruity and peace circumstance is probably going to get antagonistically influenced if Google is not restrained from the publication of the derogatory recordings.”
The Court in this way, requested an ex-parte directive for the offended party and requested Google to limit from transferring/distributing any recordings containing loathe discourse against any religion, especially Sikhism.
It additionally guided Google to bring down all recordings of Sakshi Bhardwaj containing abhor discourses about Sikh Gurus and Sikh religion.
