Up to 3-yr jail for looking at minor with sexual intent under POCSO, says Bombay HC

In a critical decision, the Bombay high court has held that taking a gander at a minor kid or a young lady is culpable under the Protection of Children from Sexual Offenses (POCSO) Act, 2005.

“Viewing a kid with sexual purpose goes under naughtiness secured by Section 11 of the POCSO Act,” said Justice AM Badar, while dismissing a request of recorded by two Daman occupants.

Area 11 of the POCSO Act characterizes ‘inappropriate behavior of a tyke’, and incorporates the words ‘always viewing a kid with sexual expectation’. This offense is deserving of up to three years’ detainment and fine under Section 12 of the Act.

“In this manner, it can’t be said that there are no adequate grounds to continue against the charged for the offense as characterized by Section 11 and made culpable under Section 12 of the POCSO Act,” the judge stated, alluding to the way that a minor young lady had named him as “having awful eye on her” in her announcement to a metropolitan officer.

In her announcement, the young lady expressed that “he generally used to see her with terrible aim”, the judge stated, while dismissing the request.

The couple had moved toward the high court (HC), trying to suppress the First Information Report (FIR) against them under arrangements of the POCSO Act. Moreover, it was likewise contended for their benefit that the FIR depended on the dubious objection and there was no material to continue ahead with the trial of the pair.

Equity Badar, in any case, said there was material to continue against the denounced as the casualty herself had expressed that he generally “took a gander at her with terrible expectation”, and whether the demonstration was with “sexual aim” or not involves truth that can be chosen just at the trial and not something else.
